We gathered over 650 signatures in our recent petition drive that we sent to Snohomish County.

Watching in that order gives better clarity to the problems posed by NorthPoint in general and specifically in a development in Illinois. The problems are pretty much the same for all of us with regards to NorthPoint development here on 228th in our neighborhoods.

NorthPoint is a Missouri based multi-billion dollar developer with a less than ideal track record. You can click on link in the header to view videos of what other cities and neighbors have experienced from NorthPoint's tactics.
Main reasons WE oppose:
NorthPoint has a history of doing the opposite of what they say they will do. In the videos you will see promised beautifications that were never done. NorthPoint has a history of over-speaking and under-delivering. We do not believe the planned NorthPoint apartments development will look like the drawings. We already know that the failed bioswale that was built behind homes on 9th Pl W was to have shrubbery that has never been planted.
NorthPoint is mostly funded by foreign investors who could be anyone from anywhere, and not monies we want in our community.
Over and over in our research, NorthPoint has misrepresented the truth about critical areas/wetlands, stormwater provisions, methane dangers, and done devious tactics to gain a foothold in our community.
NorthPoint conducted a traffic analysis NOT a traffic study, it was done during C-19 times of far less traffic than normal, and only went about 1/2 mile in 3 directions. This is another historical tactic of this company.
SaveBothell is representing the surrounding communities to say
NO TO NORTHPOINT.
They are not a developer that we want here.
Snohomish County Planning and Development Services (PDS) reviews and permits developments in Snohomish County. The Project Manager assigned to this project is Joshua Machen. SaveBothell has had multitudes of conversations with him about the egregious nature of this development and the County's responsibilities. The Snohomish County Council oversees the PDS and other County departments. Our councilmember for our area is Jared Mead.
As of this update, Oct. 2023, we were shocked to learn in the 4th review of this project that the Sno Co Council held two public hearings,, Jan. and June, 2023, of which no one in our community received notice, before passing an ordinance change that no longer requires developers to need to request a variance for residential buildings over 45 feet tall. This was absolutely a go-around us by the developer. Our legal counsel wrote of it in this fashion: ..., another piece of outrageous behave from the SC Council. The developer of the Northpoint project needed a variance to put a 5th floor on his maga MF(multi-family) development just south of 228th. When he found out that there would be problems meeting the criteria, he simply went to the Council and they changed the law giving him five more feet, and a bonus -a gateway around vesting. Though PDS was well aware of community opposition to the project, the Council slipped it through with no notice to the concerned citizens. Just the way things go in Snohomish County."
The SCC code pertaining to landslide hazard areas is clear that this site meets those requirements. But the chief geo-tech engineer at PDS refuses to answer our requests for clarification of why the County is ignoring the lawful code requirements. We are merely told the applicant, NP, has the final say. Agreed, the code does say that, but that does not override the rest of the code requirements.
The County has not required a Traffic Study, but shuffled their way out of that one by saying 228th is not financially in arrears and so they found NP's plans to be concurrent-their terms. Meaning they have not required an adequate and honest traffic study. An analysis is not the same thing with the same results.
That property to be developed is soaked with methane and NorthPoint's plans say it will be years to remove it. In the meantime, the neighbors, and eventually apartment dwellers are subject to very dangerous respiratory problems, and fire hazards. As of this writing, we do not know what the PDS is doing regarding this issue.
We know that both the County Council and the PDS departments either through
campaign contributions or direct monetization receive from this and other developers. That seems a conflict of interest to fairly then legislate in favor of the constituents they represent.

Write to County Executive Dave Somers. Dave is up for re-election soon, so maybe remind him that WE the people want to see favorable action to stopping this development on this property.
Plans to construct 544 units in eight separate five-story tall apartment buildings on the site of the Fruhling landfill along 228th (Nike Hill) have been submitted to the Snohomish County Planning and Development Services. After years living with the trucks, dust, fires, noise, etc., unless we act now, it will soon be replaced by over 3, 000 vehicle trips everyday and structures more than twice the height of any existing building within 2 miles. The effect of proceeding as proposed will forever change our single-family neighborhoods, reducing the quality of our daily lives, as well as lowering the value of our homes.
The Missouri Based developer is a $5,000,000,000 corporation, funded by unidentifiable foreign entities. NorthPoint is organized and familiar with navigating county departments and politicians.
We believe their proposal stretches both the letter and more importantly the INTENT of the GMA (Growth Management Act).
Our group is growing rapidly. We have a database of over 500 concerned neighbors presently.

We have spent 1000's of hours now as a team researching and the conclusions are becoming clearer and clearer that NorthPoint and Snohomish County have broken many laws, not followed established codes, fraudulently misapplied codes to NP's benefit, and we have to say, outright lied when we catch them in the act of their deception.
It has been far more troubling and reaches far deeper than just fighting an intrusive, out-of-proportion development in our neighborhood.
As a result, it takes much more time (and then money) to find the deception, and work to hold both county and developer accountable to us the taxpayers, the neighbors, and the voices of reason.
I, Joan, have personally read most of the 100+ letters of concern that neighbors sent to Joshua Machen since January, 2022.
The letters are well-written with excellent points and logical, common sense reasoning.
However, as I said at the Sept. 19, 2022 meeting, these people-county and developer-do not think like you and I do.
They think in terms of power and money, money and power.
I am not singling out any individual in the county or developer, but as a whole, we have not found anyone of reason yet to respond to the law.
We will continue to fight for all of us against these egregious unlawful actions.
We did not set out to fight the breaking of laws; we thought we could reason with the county as to what the problems were with the development and that they would see and respond, but that has not been the case.

WHAT WE HAVE DONE
At this point, we have succeeded in getting the County to change its requirement for pushing through 11th Ave. W to 228th. That is a huge win, but we still must stop this development as planned because of every other negative impact it will have on all our neighborhoods.
We have hired specialists in traffic, and geo-technical, architectural, stormwater, and overall site work.
We have retained legal counsel to help us fight these illegal, unpermitted activities now and in an appeal process if we need to go that far to fight the illegalities attempting to be passed on all of us.
We can do the work, but we cannot pay the bills. Please donate. If everyone reading our website and our emails donates $100 minimum we could make our goal.

Areas of concern:
Eastglen, Meadowcreek Park East, and Meadowcreek Park will all be
sorely affected from run-off since the plans are not adequate for handling the run-off and the bioswale already failed before the development is built!
Wandering Glen and the cottages will be sorely affected by run-off.
Canyon Ridge Condos, 7th Pl W cul-de-sac, Isabella Park, and 16th cul-de-sac will all be affected by 3,000-5,000 more average daily trips on 228th with not being able to get out in traffic, and having u-turns happening in their entrances, and their peek-a-boo sunset views blocked.
All HOA's and developments of single-family homes bordering 228th ST SW, 14th Ave W, and Locust south to Kenmore and northwest to Brier will be badly affected by increased traffic.
The county basically only considers issues that affect public safety or environmental. The definition of environment is:
"the surroundings or conditions in which a person, animal, or plant lives or operates."
So, our concerns of methane, water run-off, traffic, traffic, traffic, are all environmental to write the county about those.
This development is out of place for this community.
There is no transit or services nearby for residents.
Soil and water contamination is not being addressed properly by the county or NP, and all of us are affected, as well as future residents.
